Terms of Use
"Yakumail" (the term "service" refers to Yakumail) is email, data, contents (the term "data" refers to email, data, contents, and translated texts), and translation service in an Internet/Web email format offered by Sociolink Co ., Ltd. (the terms "we," "us," "our," and "ours" refer to Sociolink Co ., Ltd). The following terms of use (the term "the terms of use" refers to the following terms of use) outline your obligations as users (the terms "users", "you", and "your" refer to users of our service). By using our service, you are agreeing to the terms of use.
1. Definitions
In the terms of use, "original text(s)" refers to the text, sentence, or passage that users request translation service of and "deliverable(s)" refers to the text, sentence, or passage that we translate in-house or by outsourcing.
2. Age Limit
Users must be at least 18 years old of age.
3. Data Management and Warranty
(1) Users may not send or receive the following data:
- Data that may violate copyrights, trademarks or other rights
- Data that contain immoral images or may be harmful to minors
- Data that contain biases, discrimination or harassment
- Data that promote illegal activities or are used for religious activities
- Data that are suspected to violate the privacy rights of individual(s), group or company or harass, abuse, or threat them
- Data that are suspected to be used for harmful programs or their introduction
- Data that are illegal in Japan, United States, and other countries
- Data that are sent or received multiple times for promotional purposes
- Data that impede service or compromise trust of service
(2) If we find such data described above, we have rights to suspend sending or receiving the data and to delete partial or all data without notice or approval by users. Moreover, we will not notify users about pending or deletion and we will not be liable for any loss or damage caused by suspension or deletion.
(3) We have rights to delete user accounts that are not used for a certain period of time. In such case, we do not notify users and are not liable for any loss or damage.
(4) We may monitor or save data for the management and maintenance of email server or the website.
4. Compensation for Loss or Damage
(1) Users are solely responsible for all data exchanges through our service. We are not responsible for any loss, damage, detriments, or third-party issues to users or the third party. This includes but not limited to the following:
- Any issues or detriments caused by the data users send or receive
- Any issues or detriments caused by sending or receiving the translated data
- Any issues or detriments caused by the translated data, translation method, or translated contents
- Any issues or detriments caused by users' action regardless of fault or intent
- Any issues or detriments caused by the loss of the data
(2) If we receive litigations or experience a loss due to users' data, we have rights to charge the users for all loss and damages and to claim the users responsible for the loss and damages. These data include the data that are not displayed on the website or that were sent in the past.
(3) Users are responsible for managing ID, password and any information needed for Login. We are not responsible for any loss or issues arisen from ID, password, or information loss or theft. Users shall understand that they can use service with their ID by saving their Login information. Users shall understand that they prevent information loss or theft by not saving Login information in the third-party computer. We are not responsible for any issues arisen from the abuse or theft of ID, password or any other information.
(4) We do not guarantee or recompense any loss arisen from unexpected events such as natural disasters, network/communication failures, or device failures. Moreover, we do not guarantee or recompense any loss arisen from problems that are not under our control. We do not guarantee or recompense any loss due to any communication failures with us or inability to send or receive data.
5. Establishment of Translation Order and Cancellation
Translation order is established when users make translation order by the method we specify. In principle, users may cancel their translation order if a translator has not started translation. Cancellation of translation order must be made by the method we specify. Other methods (including but not limited to by making phone calls or by emailing) are not allowed. If cancellation of translation order was not made by the method we specify, we are not liable for any loss or damage caused by it.
6. Intellectual Property
Upon establishment of translation order, users will give us and translators the rights to view and save original text(s). In addition, the intellectual property and copyrights of the deliverable(s) are reserved by us.
7. Translation Fees
In principle, estimate of translation fees will be displayed upon making translation order. However, the estimates are automatically calculated by system and may differ from actual fees. In such case, the adjustment of the translation fees will be made upon submission of deliverables and the adjusted fees will be charged to users.
8. Revision of Deliverables
We accept requests for revision within 24 hours from submission of deliverables, only if we made inaccurate translation. However, we do not accept any request for revision for any other reasons (including but not limited to a variety of expression styles) except inaccurate translation. If there is no request for revision made within 24 hours from submission of deliverables, we consider that you accepted our deliverables and we completed providing service.
9. Provision of Information
Users must provide information necessary for translation. If users did not adequately provide information necessary for translation, we do not revise deliverables even if they have inaccurate translation.
10. Time Required for Translation
In principle, we submit deliverables within 24 hours from the receival of translation order. Nevertheless, if the original text(s) are technical according to our judgment or exceed the given word/letter count, translation may take more than 24 hours. Even if the submission of deliverables delays, we will not be responsible for any loss or damage caused by the delay.
11. Communication between Users and Translators
Users and translators must communicate through us.
12. Payment of Translation Fees
In principle, translation fees are paid by credit card. Translation fees are charged after the submission of deliverables. After completion of payment, we cannot refund any fees under any circumstances.
13. Change of Payment Information
If there is any change in payment information, users must change the payment information before making translation order with their own responsibilities.
14. Unpaid Fees
If we cannot confirm payment from users, we have a right to suspend service.
15. Email Delivery
We may send email to users for updates or other purposes without any approval.
16. Agreements
By agreeing the terms of use, you are also agreeing other related terms of use.
17. Governing Law
The terms of use will be governed by and constructed in accordance with the laws of Japan and the United States of America.
18. Assigned Courts
Should any dispute arises, we have rights to select assigned courts.
19. Changes in Terms of Use
The contents of the terms of use are subject to change without notice. We are not liable for any trouble caused by the changes in the terms of use.
